Starlink Faces Legal Compliance Issues with Satellite Interceptions in France

Starlink, the satellite internet service provided by SpaceX, is facing legal compliance issues in France. It has been revealed that Starlink has not yet complied with certain specific provisions of French law, particularly those relating to judicial and security interceptions. These provisions allow access to the content of communications and associated connection data.

Under French law, these interceptions are controlled by the National Commission for Control of Intelligence Techniques (CNCTR) and cover various situations, including electronic communications operators and online service providers, mobile communications interception through IMSI catchers, wireless listening, and satellite interceptions.

This last category specifically concerns Starlink, as it provides internet access service in France through a constellation of satellites deployed in low Earth orbit. Starlink also operates two ground stations in France.

The extension of security interceptions to the satellite world was made possible by the law of July 30, 2021, which aims to prevent acts of terrorism and strengthen intelligence capabilities. However, Starlink has not obtained the necessary authorizations from the French National Agency for the Security of Information Systems (ANSSI).

Failure to comply with these legal requirements could result in penalties and even the suspension or withdrawal of Starlink’s authorization to operate in France. The extent of the violation will depend on the size of Starlink’s presence in France, which is currently relatively small compared to traditional internet providers.

While Starlink’s non-compliance may become a growing issue as it attracts more customers, the experimental interception capabilities granted by the 2021 law could provide some flexibility. These capabilities allow direct interception without the need to request cooperation from Starlink.

In conclusion, Starlink’s failure to comply with French legal requirements regarding satellite interceptions could lead to potential legal consequences and regulatory actions. However, the impact is currently limited due to Starlink’s relatively small customer base in France.
