Starlink Faces Legal Issues in France

Starlink, the satellite internet service provider, is facing a problem with French law. It appears that the ISP is not complying with its legal obligations and does not allow for judicial interceptions for security purposes, according to reports.

In theory, under a law passed in 2021, Internet service providers (broadly defined) must obtain ministerial authorization for the equipment they set up to enable these interceptions. The problem, according to reports, is that SpaceX, the company behind Starlink, did not apply for these authorizations, and as a result, they have not been granted.

There are various possible sanctions for Starlink, ranging from temporary or complete suspension of service to fines of up to 3% of their revenue. It is also possible for the government (through the Arcep) to dismantle Starlink’s ground stations in France, which provide internet access to its customers.

Although Starlink is a relatively small operator in France with only tens of thousands of subscribers, its offering is increasingly appealing and popular. As we have seen in our previous coverage, it provides high-speed internet to people living in poorly covered areas, at a recently affordable cost of €40/month, although the equipment itself remains expensive at €45 for the antenna.

It is worth noting that Starlink is not a perfect solution for criminals either. Intelligence services can theoretically intercept satellite communications with the assistance of operators, under an experimental law. However, this authorization is only valid until July 31, 2025, and under certain specific circumstances related to national security, preventing foreign interference, and combating terrorism, crime, and organized delinquency. As of now, this provision has not yet been utilized.
