Morgan & Morgan, a law firm, has filed a lawsuit against Tampa General Hospital (TGH) on behalf of three victims of a data breach that occurred in May. The hospital reported the breach as a “cybersecurity event” affecting approximately 1.2 million individuals.

According to TGH, the unauthorized third party gained access to patient information, potentially including names, addresses, phone numbers, dates of birth, Social Security numbers, health insurance information, medical record numbers, patient account numbers, dates of service, and limited treatment details.

The lawsuit alleges that the hospital has not been transparent about the details of the investigation into the breach. The activity in the hospital’s computer systems was initially noticed on May 31, but a subsequent investigation by a third-party forensic firm revealed that the activity actually started on May 12.

In addition, the lawsuit claims that TGH did not notify affected patients about the breach until more than two months later, leaving them vulnerable to identity theft and fraud. Some patients have already reported incidents of identity theft since the breach occurred.

TGH has reported the incident to the FBI and provided them with information for their investigation. Florida Sen. Rick Scott also wrote a letter to the FBI urging immediate action in the investigation.

The lawsuit seeks justice and accountability for the affected patients and aims to encourage TGH to improve its cybersecurity measures to protect patient privacy in light of increasing cyberattacks.

This lawsuit against TGH follows a previous data breach in 2014, indicating a pattern of alleged failure to protect patient data.
